Ultimately, bareMinerals’ marketing of the makeup is “aimed at convincing consumers” otherwise, the case alleges.
A proposed class action alleges certain bareMinerals foundation, concealer and lipstick products are not as ”clean” as advertised due to the presence of harmful per- and polyfluoroalkyl substances (PFAS), or “forever chemicals.”“We found fluorine as a surrogate for PFAS in all sorts of cosmetics,” said study author Graham Peaslee, University of Notre Dame professor of physics, chemistry and biochemistry. “We didn’t expect almost every cosmetic to light up like it did.”Per the lawsuit, the study found that around 88 percent of the 231 products tested failed to disclose on their labels any ingredients that “would explain those chemical markers.”

The 55-page lawsuit out of New York alleges bareMinerals has “unfairly gained the trust” of health-conscious consumers by touting certain makeup items as “clean,” “natural” and free from harsh chemicals and unnecessary additives while “fraudulently conceal[ing]” that some of its products are in fact made with chemicals that are ”entirely inconsistent” with the brand’s clean beauty campaign.“As alleged herein, Plaintiffs and the Classes received something worth less than what they paid for and did not receive the benefit of their bargain,” the complaint charges. “They paid for the PFAS Makeup which was supposed to be clean and natural, but they received neither.”Women who developed cancer, endometriosis or reproductive problems after using hair relaxers such as Dark & Lovely and Motions may now have an opportunity to take legal action.“In reality, the PFAS Makeup is not clean or natural as it contains potentially harmful chemicals that are in no way ‘clean’ or ‘natural,’” the lawsuit summarizes.

If, say, a settlement were to be reached for the lawsuit detailed on this page, bareMinerals customers covered by the suit would most likely receive a notice, by mail and/or email, with instructions on how to submit a claim, the details of the deal between the company and consumers, their legal rights, and more.
“As the skin is the body’s largest organ, subjecting it to absorption of PFAS through foundation and concealers is very concerning,” the complaint reads.

Generally speaking, there’s nothing you need to do to join or be considered included in a class action. It’ll only be if and when a lawsuit settles that those covered by the case, called “class members,” would need to act, which typically entails filing a claim form online or by mail.

Overall, the lawsuit says that the presence of PFAS, long-lasting chemicals that break down very slowly over time, in certain bareMinerals makeup does not jibe with what consumers expect from a brand that has proclaimed itself the “Creators of Clean Beauty.” The case alleges that each type of bareMinerals product tested by the plaintiffs was found to contain PFAS, and the company’s misrepresentations are intentional, careless and render the makeup worthless or less valuable.
According to the filing, a June 2021 study titled “Fluorinated Compounds in North American Cosmetics” analyzed whether certain products contained PFAS by assessing total fluorine content, a marker for PFAS.

Per the filing, products such as foundation and concealer, which a wearer essentially leaves on the skin for extended periods of time, pose a greater risk of PFAS exposure than others that are washed off immediately after application.
The lawsuit relays that PFAS are highly persistent and potentially harmful human-made chemicals that have been associated with “a variety of negative health effects for humans and the environment.” Per the suit, PFAS are sometimes called “forever chemicals” since their carbon-fluorine bonds are some of the strongest in nature. Health risks associated with PFAS, the lawsuit says, citing one beauty blogger, can include increased cholesterol, increased blood pressure during pregnancy, increased risk of kidney or testicular cancer, and decreased vaccine response in children.

What has happened to BareMinerals?
Announced in August 2021, the acquisition of the companies was completed on December 6. The brands now share a central global headquarters on Fifth Avenue in New York under Orveon, the new affiliate that was formed as a part of the deal.
Keep in mind, though, that class actions tend to take some time to work through the legal process, usually toward a settlement, dismissal or arbitration outside of court. The parent company stated that the brand is the “only brand within the Shiseido Group that is competitive in the growing natural cosmetics market” and affirmed that it will continue to invest in the brand.As part of its financial forecast for the end of year, Shiseido Co. Ltd. has announced it will close 100 bareMinerals stores in the U.S., according to WWD. There are currently 209 stores in the U.S., and the company pegs that “a full 30 percent of American women use the brand.”

Köpte ready foundation i R170… Tror den är bra men är lite osäker (kanske beror på att den täcker MKT bättre? :)) men om jag skulle vilja ha en snäppet ljusare är det R150 eller tom R110 jag ska ha? Jag har nu testat R170 och den funkar perfekt på mig. I lösa varianten har jag kört med både fair och fairly medium. Då tycker jag Fairly light är lite för gul och mörk för mig men i ready funkar den perfekt. Kanske kan det hjälpa någon!

I dagsläget kör jag JM serie med gentle cleanser, cesta cream, biocleare cream och transformation cream. Och min hud fullkomligt slukar produkterna, de tar slut på stört… jag gillar ändå produkterna tycker huden blivit bättre från acne men jag e så himla torr. Jag har använt JMs holiday scrub ngn dag i veckan och använder dermalogicas ultracalming mask 1-2ggr i veckan rikligt. Men den blir liksom aldrig nöjd. Jag har en superkänslig hud som tyvärr reagerar på en del produkter..Den ger medium till full täckning beroende på vilken borste man använder och känns faktiskt magiskt viktlös på huden. Passar alla hudtyper som vil ha en hudvårdande mjuk foundation.

Jag har oxå en fråga ang färg.. Förstår att det är jättesvårt att råda per mejl, men tar gärna emot ett tips. Jag är lite mörkare med gul underton. Har därför svårt att hitta rätt nyans. Använder id’s golden medium, som jag blandar med pyttelite tan eller golden tan. Finns det ngn nyans som är lite mörkare än golden medium, men fortfarande gul. Ha det gott. Hej vi har just för en diskussion om våra nagelförlängningar, det blir ju så smutsigt under nageln och hur hygieniskt det är när man tar creme på fingret och smetar i ansiktet….lösningen borde ju vara att använda spatel men vi blev nyfikna på vad du anser kram kram
Hej Carina, Håller med. Egentligen gillar jag inte nagelförlängningar men personligen har jag alltid så korta som det går. Jag använder alltid, alltid spatel. med eller utan förlängning. Sen är en nagel borste ett måste så man kan borsta ordentligt rent när man tvättar händerna. Kram AnnicaHej Malin, Åhh så svårt att säga.. Jag har en liten guide från Original foundation till nya ready men Matte skiljer sig. Jag tycker du besöker en fysisk butik första gången och provar ut så du får exakt rätt ton! Hej igen! Det stämmer R170 är READY Fairly Light i USA. Ja ibland vill man gå upp någon nyans om man har en färg i original. Därför tog man bort namnen för det hela blev väldigt förvirrande! KRAM Annica

Den var lite för blek för min hy, annars kändes den skön att ha på och huden blev naturligt jämn förutom att den var för ljus. bra produkt om jag fått rätt färg.

Ultranöjd med denna produkten. Täcker perfekt, utan att se onaturligt ut, och det bästa är att den håller hela dagen, även efter en snabb (och svettig) cykeltur! Har alltid varit skeptisk till pudriga mineralfoundations och stenhårt kört på flytande, men denna är min nya favorit. Längtar tills den dimper ner i brevlådan!

Även om jag inte är lastgammal funkar inte mineralpuder på mig då jag är över 30. Den lägger sig i rynkorna och framhäver dem dest mer. Vanlig foundation och puder funkar bättre. Svår att applicera med så liten borste också

Is mineral makeup better than regular makeup?
Mineral makeup is generally considered to be significantly safer than traditional makeup. It doesn’t contain any of the chemicals, dyes or synthetic fragrances of other makeups and is therefore gentler on your skin.

Orveon plans to do a brand revamp, with a focus on “modernizing, digitalizing and internationalizing” the brand. This will include the incorporation of wellness concepts into the branding, as well as the addition of skin-care ingredients into new products. The formulation process will be overseen by Orveon’s newly hired chief science officer, Mike Wong. New products developed will “replace the existing non-performing SKUs” in the brand’s future product lineup.Laura Mercier’s branding is “all about the artistry and the education we use for makeup artists and influencers around the world,” he said. The brand will continue to build its business in the U.S., which is its biggest single market with 50% of all its sales. It will also focus on modernizing its product lineup and focusing on products and promotions “that resonate better with the millennials,” said Houdayer. International expansion will be a big focus for the brand, which launched in China last August.

Digitally, the brand will focus on a new customer relationship management (CRM) system focused on targeting a customer it calls the “healthy purist.” And while the brand has been working with Hailey Bieber as a brand ambassador, Houdayer said there are plans being developed to introduce “a collective of influencers,” with diversity in mind.
The branding will be all “about self-expression,” he said. “This brand has huge potential, for example, in certain areas and regions where women are not as free as they are in developed markets.” Announced in August 2021, the acquisition of the companies was completed on December 6. The brands now share a central global headquarters on Fifth Avenue in New York under Orveon, the new affiliate that was formed as a part of the deal. That same month, Toxin Free USA, a nonprofit organization focused on food and the environment, sued CoverGirl for false advertising after testing showed that its TruBlend pressed powder foundation contained organic fluorine levels of more than 6,000 parts per million (ppm)—for reference, experts say that 100ppm or higher likely indicates intentional use of PFAS. The nonprofit alleged the test results run counter to the company’s sustainability claims on its website and reports, such as touting itself as the “original founder and creator of clean beauty.”Besides potential lawsuits, the cosmetic industry has other causes for concern as the U.S. Environmental Protection Agency moves to regulate the compounds, webinar presenters said. The agency’s request to list PFOA and PFOS, two especially toxic PFAS, as hazardous substances could create “significant” cleanup responsibilities for companies that have released PFAS into the environment—particularly since other PFAS can break down into those two compounds, said Matt Walker, an attorney for Lathrop GPM.If the next six months of 2023 are anything like the first six, the ability of people to normalize global warming may be put to its most severe test yet. Cosmetics companies could face litigation if their products are found to contain PFAS, warn attorneys, as a rash of recent lawsuits hit companies touting themselves as clean but whose products contain evidence of “forever chemicals.” These studies were the “springboard” for a wave of lawsuits, said Cunningham. A class-action lawsuit filed in December against bareMinerals alleged that the makeup company, which has five organic fluorine-containing products, “unfairly gained the trust of consumers” by advertising that its products were “free of harsh chemicals,” among other claims.Additionally, a number of states are looking to follow in the footsteps of Maine and Maryland, which have banned PFAS from being added to cosmetics. At least 32 states are considering laws that would ban or restrict PFAS, including their use in personal care products, according to an analysis published last month from the Safer States network.

Meanwhile, green beauty company Burt’s Bees faces a class action lawsuit filed in February based on the Mamavation testing, which found that two of its mascaras had levels of organic fluorine indicative of intentionally added PFAS.
While the lawsuits seem unlikely to succeed given a 2018 Danish study that found PFAS levels in makeup are too low to pose a risk to wearers , the potential for litigation still represents a “real vulnerability” for the cosmetics industry, Cunningham said.

The lawsuits are a harbinger of future liabilities for the cosmetics industry, with efforts underway in the U.S. to restrict the sale of makeup made with the compounds—and even designate some PFAS as hazardous.
She drew parallels to a rash of lawsuits facing grocers like Kroger and Albertsons after it was discovered that some of their compostable dishware likely contained PFAS. Kroger agreed in a settlement reached last year to stop saying that the product line in question was compostable. Last year, a team of researchers from the University of Notre Dame and other institutions tested fluorine levels—a potential indicator for PFAS—in more than 200 cosmetics, finding that about half had fluorine.
